Theodore Gwinnett, of Cheltenham, 1827

This is the last will and testament of me, Theodore Gwinnett, of Cheltenham in the county of Gloucester, gentleman.

I direct all my just debts to be paid and subject thereto and as after mentioned, I give, devise and bequeath all my real and personal estate to my dear wife, Mary Gwinnett, her heirs, executors and administrators subject to the payment of fifty two pounds per annum to my mother during her life by equal quarterly payments to commence at my death.

And I appoint my said wife sole executrix of this my will, in witness whereof I have hereunto set my hand and seal the first day of October in the year of our Lord one thousand eight hundred and twenty four.

Signed, sealed, published and declared by the said testator as and for his last will and testament in the presence of us who in his presence, at his request and in the presence of each other have hereunto subscribed our names as witnesses: M Waddington of Cheltenham, Jno Gibbon and William Daniell, clerks to Messrs Gwinnett & Newman, Solicitors in Cheltenham.

On the nineteenth day of June in the year one thousand eight hundred and twenty five, the above will was resigned, sealed published and declared by the above named testator Theodore Gwinnett in consequence of his having agreed with Walter Lawrence Lawrence Esquire or his trustee for the purchase of freehold and copyhold property in the county of Gloucestershire to the amount of twenty thousand pounds and upwards and other property of other persons in the presence of us who in his presence, at his request and in the presence of each other have hereunto subscribed our names as witnesses: M Waddington of Cheltenham, Charles Rogers Coxwell & Robert Clark.

On the twenty eight day of June in the year one thousand eight hundred and twenty five, the within will was re-signed, sealed, published and declared by the within named testator, Theodore Gwinnett, in consequence of his having previously signed the contracts or agreements between him and the within named Walter Lawrence Lawrence for the purchase of the premises within referred to and others amounting altogether to twenty three thousand and fifty six pounds in the presence of us who in his presence, at his request and in the presence of each other have hereunto subscribed our names as witnesses: Charles Lucas, clerk to Messrs Gwinnett & Newman, Solicitors, of Cheltenham, Ann Williams, John Lan? Brook, servants to Mr Gwinnett.

On the twenty fourth day of December one thousand eight hundred and twenty five, the within will was re-signed, sealed, published and declared by the within named testator, Theodore Gwinnett, in consequence of his having contracted for the purchase of other real property since the last republication and particularly of Joseph Pitt, esquire, in the presence of us who in his presence, at his request and in the presence of each other have hereunto subscribed our names as witnesses: M Waddington, Ann Williams, Rebecca (Hoskins?).

The will of T Gwinnett sealed 1st October 1824, republished 18th June 1825 & 28 June 1825.

Proved at London 15 September 1827 before the (judge?) by the oath of Mary Gwinnett, widow, the relict and sole executrix to whom administration was granted being first sworn by Commission duly to administer.
